Court awards Lord Mayor Sh50m for squeezing his ‘Balls’

In a judgement delivered on Monday afternoon by Hon. Lady Justice Henrietta Wolayo the High court judge, Erias Lukwago the Lord Mayor for Kampala Capital City Authority (KCCA), was awarded Sh50m in compensation for damages caused by police while he was being arrested on September 21, 2017.

Lukwago had filed a civil suit Misc. case no.429 in December 2017, seeking for declaration that Police backed by plain-clothed men violated his freedom from torture, cruel, inhuman and degrading treatment under Article 24 and 44 of the Constitution. He was also seeking for declaration that his right to privacy was violated when Police forcefully invaded and forced its way into his home before he got arrested.

The Lord mayor among others, presented photographs and news clips showing how police officers led by ASP Grace Nyangoma manhandled him, later screaming like a baby before he was bundled into a caged van and taken to Kira police station from where he whisked to Naggalama police station.

While delivering her judgement on May 11, 2020, Lady Justice Wolayo noted that whereas the Lukwago was not subjected to torture, cruel and inhuman treatment; he was subjected to degrading treatment when he was grabbed and bundled onto a caged van by police officers in violation of his rights. This happened at the applicant’s home in Lubaga division, Kampala.

“I consider the sum of Sh50,000,000= adequate as compensation for unlawful arrest and violation of his right to liberty as protected by Article 23; violation of his right to Privacy of his home as protected by Article 27 and degrading treatment during arrest protected by Article 24 of the constitution,” read in part the 10-page judgement.

On addition to compensation, government was ordered to pay for the cost of Lukwago’s application. “The compensation shall carry interest at 10% p.a from the date of this ruling until payment is full,” the judge added.
